Terms and conditions of the newsletter

of the Landscape Store

 

The provisions regarding the Privileged Entrepreneurs apply to contracts concluded from 1 January 2021.

§ 1 DEFINITIONS

 

Consumer - a consumer as defined by the Civil Code.

Newsletter - a free-of-charge electronic service whereby the Customer may receive from the Service Provider by electronic means pre-ordered messages relating to the Store, including information on offers, promotions and new products in the Store.

Privileged Entrepreneur - an individual who enters into a contract with the Service Provider that is directly related to his or her business but is not of a professional nature (the definition applies to contracts entered into from 1 January 2021). 

Store - Landscape Store operated by the Service Provider at https://landscapestore.pl.

Customer - any entity that uses the Newsletter service.

Privileged Customer - Consumer or Privileged Entrepreneur. 

Service Provider - LANDSCAPE SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ with registered office at Jasełkowa 10 street, 71-804 Szczecin, entered into the National Court Register - Register of Entrepreneurs by the REGON JUDGE SZCZECIN-CENTRUM IN SZCZECIN, XIII ECONOMIC DEPARTMENT OF THE NATIONAL Court Register, under No. KRS 0000881306, NIP 8513256476, REGON No. 38809899800000, share capital 30000,00 zł.

 

§ 2 Newsletter

 

  1. The Customer may use the Newsletter service voluntarily.
  2. In order to use the Newsletter service it is necessary to have a device with a web browser in the latest version, supporting JavaScript and cookies, with access to the Internet and an active e-mail account.
  3. Emails sent under this service shall be sent to the email address provided by the Customer when signing up for the Newsletter.
  4. In order to conclude a contract and sign up for the Newsletter service, the Customer shall provide in the first step, in the designated place in the Store, their email address to which they wish to receive messages sent as the Newsletter. Upon subscribing to the Newsletter a service contract shall be entered into and the Service Provider shall commence providing the service to the Customer - subject to the provisions of section 5.
  5. In order for the Newsletter service to be carried out properly, the Customer shall provide a valid email address.
  6. Messages sent within the Newsletter shall include information about the possibility to unsubscribe from it, as well as a link to unsubscribe.
  7. The Customer may unsubscribe from the Newsletter at any time without giving any reason or incurring any costs, using the option referred to in point 6 or sending a message to the e-mail address of the Service Provider: kontakt@landscapestore.pl.
  8. When the Customer uses the unsubscribe link from the Newsletter or sends a message with a request to unsubscribe from the Newsletter, it results in immediate termination of the contract for the provision of this service.

 

§ 3 Complaints

 

  1. Complaints relating to the Newsletter shall be reported to the Service Provider at the following email address: kontakt@landscapestore.pl.
  2. The Service Provider shall respond to complaints within 14 days of receiving a complaint.

 

OUT-OF-COURT WAYS OF DEALING WITH COMPLAINTS AND CLAIMS

  1. In the event that the complaint procedure fails to produce the result expected by the Customer who is a Consumer, the Consumer may use, inter alia:
    1. mediation conducted by an adequate Voivodeship Inspectorate of Trade Inspection, to which an application for mediation should be submitted. As a rule, the procedure is free of charge. The list of Inspectorates can be found here: https://www.uokik.gov.pl/wazne_adresy.php#faq595;
    2. the assistance of an adequate permanent consumer arbitration court operating at the Provincial Trade Inspection Inspectorate, to which an application for mediation should be submitted.     3. free assistance from the municipal or district Consumer ombudsman;
    4. the ODR Internet platform available at: : https://ec.europa.eu/consumers/odr/main/?event=main.home.howitworks.

 

§ 4 Personal data

 

  1. The administrator of personal data provided by the Customer in connection with subscribing to the Newsletter shall be the Service Provider. Detailed information on the processing of personal data by the Service Provider - including other purposes and grounds for data processing, as well as on data recipients, can be found in the Privacy Policy available at the Store - in view of the transparency principle, contained in the General Regulation of the European Parliament and of the Council (EU) on data protection - "GDPR".
  2. The purpose of the processing of Customer's data is the sending of the Newsletter. The basis for the processing of personal data in this case is a service contract or actions taken at the request of the Customer with a view to conclude such a contract (Article 6(1)(b) GDPR), as well as the Service Provider's legitimate interest in processing data in order to establish, assert or defend potential claims (Article 6(1)(f) GDPR).
  3. Providing data by the Customer is voluntary, but at the same time necessary to provide the Newsletter service. Failure to provide data means that the Service Provider will not be able to provide this service.
  4. Customer data will be processed until:

 

    1. the Customer unsubscribes from the Newsletter;
    2. the possibility for the Customer or the Service Provider to assert claims related to the Newsletter ceases;
    3. the Customer's objection to processing of their personal data is accepted - if the data processing was based on the Service Provider's legitimate interest

 

- whichever is applicable in a given case and which shall occur at the latest.

  1. The Cusomter has the right to request:
    1. access to his/her personal data,
    2. rectification
    3. erasure,
    4. restriction of processing,
    5. the transfer of the data to another controller

as well as the right to:

    1. object at any time to the processing of data on grounds related to the particular situation of the Service Recipient - to the processing of personal data concerning them based on Article 6(1)(f) of the GDPR (i.e. on the legitimate interests pursued by the controller).

 

  1. In order to exercise their rights, the Customer should contact the Customer may file a complaint with the President of the Office for Personal Data Protection.

 

§ 5 Final provisions

 

  1. The Service Provider reserves the right to amend these terms and conditions only for important reasons. Valid reason shall be understood as the necessity to amend these terms and conditions due to modernisation of the Newsletter service or change of legal regulations which impact provision of the service by the Service Provider.
  2. Information on planned amendments to the terms and conditions shall be sent to the Customer's email address provided when signing up for the Newsletter at least 7 days before the amendments become effective.
  3. If the Customer does not object to the planned changes until they come into force, it is assumed that they accept them.
  4. If the Cudtomer does not accept the planned changes, they should send information about it to the e-mail address of the Service Provider: kontakt@landscapestore.pl, which will result in termination of the contract for the provision of services upon entry into force of the planned changes.
  5. It is forbidden for the Customer to provide unlawful content.
  6. The Newsletter service provision contract shall be concluded in the Polish language.
  7. In the case of a Customer who is not a Privileged Customer, the competent court shall be the court with jurisdiction over the Service Provider’s registered office.

YOUR RIGHTS

 

You are entitled to request:

 

  • to access to your personal data, including obtaining a copy of your data (Article 15 GDPR or, if applicable, Article 13(1)(f) GDPR),
  • to rectify (Article 16 GDPR),
  • to delete (Article 17 GDPR),
  • to restrict processing (Article 18 GDPR),
  • to transfer the data to another controller (Article 20 GDPR).

 

You also have the right:

 

  • to object at any time to the processing of your data:

 

  • on grounds relating to your particular situation, to the processing of personal data concerning you based on Article 6(1)(f) of the GDPR (i.e. the legitimate interests pursued by us) (Article 21(1) of the GDPR);
  • if personal data is processed for the purposes of direct marketing, to the extent that the processing is related to such direct marketing (Article 21(2) GDPR).

1. Placing an order in the Store

until the account is deleted by you or by us at your request

in addition, your data will be processed until the expiry of the period during which it is possible to assert claims - by you or by us (see the last table in this section for more information)

What happens if you do not provide the data?

you will not be able to create an account and use its features such as viewing your order history or checking your order status

 

3. Getting in touch with us (e.g. to ask a question)

to handle your queries or requests

On what basis?

contract or action taken at your request with a view to conclude such a contract (Article 6(1)(b) of the GDPR) - in the case your query or request concerns a contract to which we are or may be a party

our legitimate interest in processing your data in order to communicate with you (Article 6(1)(f) of the GDPR) - in the case your query or request is not related to a contract

for the duration of the contract between us or, if no contract has been concluded, for the duration of the claim period - see last table of this section*

to analyse how you use and navigate around the Store’s website, in order to adapt the website to your needs and behaviour (you can read more about this in the "Analytical activities" and "Cookies" sections of the Privacy Policy)

our legitimate interest in processing the data for the purpose stated above (Article 6(1)(f) GDPR)

until the cookies used for analytical purposes expire or you delete them*

we will not take your Store use preferences into account in our development of the Store

5. Your consent to receive marketing content from us (e.g. information about special offers)

to send marketing information, particularly special offers

your consent to our marketing activities (Article 6(1)(a) of the GDPR)

until you withdraw your consent - remember, you can withdraw your consent at any time. The processing of data until you withdraw your consent remains lawful.

6. Newsletter subscription

to send out our newsletter

contract for the provision of newsletter dispatch services (Art. 6(1)(b) GDPR)

until you unsubscribe from our newsletter

in addition, your data will be processed until the expiry of the period during which it is possible to assert claims - by you or by us (see the last table in this section for more information)

What happens if you do not provide the data?

you will not be able to receive information about the Store and our services

 

7. Take any action or omission which may give rise to a claim relating to the Store or our services

 

For what purpose?

to establish, pursue or defend potential claims related to the contract concluded or services provided

On what basis?

our legitimate interest, consisting in the processing of personal data for the aforementioned purpose (Article 6(1)(f) GDPR)

For how long?

until the expiry of the limitation period for claims or until we have taken account of your objection to the processing*

What happens if you do not provide the data?

inability to establish, assert or defend claims

PUBLICATION OF DATA

 

If you choose to publish a comment, its content and your signature will be visible to other Store users.

 

We do not disclose your email address to other users - unless you do so yourself.

 

ANALYTICAL ACTIVITIES

 

We conduct analytics within the Store to help make it more intuitive and accessible - this will be done for you if you allow it. Analytics will take into account how you navigate the Store, how much time you spend on a particular subpage and where you click in the Store. This allows us to adapt the layout and appearance of the Store and the content placed therein to the needs of our Users.

 

DATA SECURITY

 

When processing your personal data, we apply organisational and technical measures in accordance with the relevant provisions of law, including the use of connection encryption with the SSL certificate.

 

COOKIES

 

Our Store, like most websites, uses so-called cookies (cookie files). These files:

  • do not change the settings of your device.
